The First Amendment protects the right of individuals to express opinions and discuss matters of public concern, while recognizing that some categories of speech receive less or no constitutional protection (such as true threats, certain forms of defamation, or incitement under established legal standards).
The Constitution protects the press from government censorship and recognizes the important role of journalism in informing the public.
These protections apply broadly and are not limited only to traditional newspapers or television broadcasters. Modern media organizations, independent journalists, documentary creators, and digital publishers may all engage in constitutionally protected press activities, subject to generally applicable laws.
One of the strongest protections under American constitutional law is the principle that the government generally may not prevent publication before it occurs except under extraordinary circumstances.
